Products sold through MarketingOlfactiv.ro benefit from the warranties and rights provided by applicable legislation, depending on the type of product and the status of the buyer – consumer or professional customer.

Legal guarantee of conformity for consumers

For new products purchased by natural persons acting as consumers, MARKETING OLFACTIV S.R.L. is liable for any lack of conformity identified within 2 years from the date of delivery, in accordance with applicable legislation.

The legal guarantee of conformity applies at no additional cost to the consumer and is separate from any additional commercial warranty that may be offered by Marketing Olfactiv or by the manufacturer.

What is considered a lack of conformity?

A product may be considered non-conforming when, under the conditions provided by law, it does not meet the characteristics, functionality, quality or normal use presented at the time of purchase.

In the case of scent diffusers, a lack of conformity may include, for example, a technical defect affecting the device, power supply system, nebulization mechanism or electronic functions, provided that the issue was not caused by improper use of the product.

What remedies are available in the event of a lack of conformity?

In the event of a lack of conformity covered by the legal guarantee, the consumer may request that the product be brought into conformity by repair or replacement, under the conditions provided by law.

The choice between repair and replacement is made within the limits established by applicable legislation, including the technical feasibility of the requested remedy and the proportionality of the related costs.

If repair or replacement cannot be carried out under the conditions provided by law, the consumer may be entitled, as applicable, to a proportionate price reduction or termination of the contract, in the circumstances provided by applicable legislation.

How long does repair or replacement take for consumers?

For consumers, the repair or replacement of a product covered by the legal guarantee must be carried out free of charge, within a reasonable period that may not exceed 15 calendar days from the moment Marketing Olfactiv is informed of the lack of conformity, in accordance with applicable legislation.

The remedy must be provided without significant inconvenience to the consumer, taking into account the nature of the product and the purpose for which it was purchased.

Who pays for transport when a product is covered by warranty?

For consumers benefiting from the legal guarantee of conformity, the costs required to bring the product into conformity, including shipping and transport costs, are borne by Marketing Olfactiv, under the conditions provided by law.

To identify the product and the order, you will need to provide a document or information that proves the purchase was made from Marketing Olfactiv, such as the invoice, order number or other available purchase documents.

Products requiring technical inspection will be collected or sent in accordance with the instructions provided after the warranty request has been registered.

Use of compatible fragrances and consumables

The scent diffusers sold by Marketing Olfactiv are designed and tested for use with ambient fragrances that are compatible with the technology and technical specifications of each device.

To ensure correct operation, maintain performance and avoid damage to the nebulization components, we recommend using only ambient fragrances supplied or approved by Marketing Olfactiv for the respective model.

The use of fragrances, oils, essences, solutions, diluents or other liquids that are not compatible with the device specifications may cause, among other things, clogging of the nebulization system or damage to the pump, seals, tubing or other components.

If the technical inspection establishes that a defect was caused by the use of a fragrance, consumable or liquid that is incompatible with or not approved for the respective device, the repair of that specific defect is not covered by warranty.

This provision does not limit the legal guarantee of conformity or the consumer's statutory rights in relation to product defects that are unrelated to the use of incompatible consumables.

What is not covered by the warranty for lack of conformity?

The warranty does not cover situations where the issue does not constitute a lack of conformity attributable to the product or seller, including, where applicable:

• damage caused by impact, dropping, mechanical shock, contact with liquids or other accidents;
• use of the product contrary to its instructions or intended purpose;
• unauthorized interventions, modifications or repairs;
• use of incompatible power supplies, components or accessories where these caused the defect;
• use of fragrances, liquids or consumables that are incompatible with or not approved for the device where these caused the defect;
• normal wear and tear resulting from use;
• deposits, clogging or damage caused by improper use of consumables;
• damage caused by improper storage or maintenance.

The existence of any of the situations above will be assessed based on the actual cause of the defect and does not limit the consumer's statutory rights where the product has a lack of conformity for which the seller is legally responsible.

Fragrances and consumable products

Ambient fragrances and other consumable products benefit from the statutory rights relating to product conformity. However, normal consumption of the product, normal variations in olfactory perception or the perceived intensity of a fragrance do not, in themselves, constitute a technical defect.

The intensity and consumption of an ambient fragrance may vary depending on the surface area and volume of the space, ventilation, temperature, diffuser placement and operating settings.

Products with apps or digital elements

For products that include or use digital elements, such as app control, Bluetooth, Wi-Fi or other software functions, the legal requirements relating to the conformity of digital elements also apply where such elements form part of the product or are required for its intended use.

Information regarding compatibility, functionality and, where applicable and provided by the manufacturer, software updates is presented in the product description or accompanying documentation.

Commercial warranty

Certain products may benefit from an additional commercial warranty offered by Marketing Olfactiv or by the manufacturer. The duration and conditions of any such warranty are those stated in the warranty certificate, product page or documents supplied with the product.

An additional commercial warranty does not limit or replace the legal guarantee of conformity available to consumers.

Warranty for purchases made by companies

For products purchased by legal entities or other professionals for purposes related to their economic activity, the specific legal regime governing consumer protection does not automatically apply.

For such purchases, electronic and electrical products benefit from a 12-month commercial warranty, unless a different period is specified in the offer, contract, invoice, warranty certificate or product page.

For scent diffusers purchased by professional customers, the commercial warranty requires compliance with the operating instructions and the use of consumables that are compatible with the device. Defects caused by the use of fragrances, liquids or consumables that are incompatible with or not approved by Marketing Olfactiv are not covered by the commercial warranty.

Warranty handling time for professional customers

For purchases made by legal entities or other professionals, commercial warranty requests will be assessed and resolved within a maximum period of 30 calendar days from the date on which the product and the information required for inspection are made available to Marketing Olfactiv, unless a different period has been agreed in the offer, contract or other commercial documents.

Depending on the nature of the defect, the resolution may involve technical inspection, repair, replacement or another solution agreed between the parties.

The transport procedure and any related costs for B2B purchases are governed by the applicable commercial documents or communicated as part of the service procedure.
