Terms and Conditions

This document sets out the terms and conditions governing the use of MarketingOlfactiv.ro, as well as the conditions applicable to orders and contracts concluded through the online store.

Please read this information before placing an order. By submitting an order and accepting the Terms and Conditions during checkout, you confirm that you have read and understood the applicable provisions.

The version of the Terms and Conditions in force is the version available on this page at the time the website is used or the order is placed.

Throughout this document, MARKETING OLFACTIV S.R.L. may also be referred to as “Marketing Olfactiv”, “the seller”, “the merchant”, or “we”.

2. Applicable legal framework

The activity of the online store and its relationship with consumers are governed, where applicable, by Romanian and European legislation in force, including:

• Government Ordinance no. 21/1992 on consumer protection;
• Government Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals;
• Government Emergency Ordinance no. 140/2021 on certain aspects concerning contracts for the sale of goods;
• Law no. 365/2002 on electronic commerce;
• Law no. 363/2007 on unfair business-to-consumer commercial practices;
• Law no. 193/2000 on unfair terms in contracts concluded between professionals and consumers;
• Regulation (EU) 2016/679 regarding the protection of personal data, where applicable.

3. Consumers and business customers

For the purposes of consumer protection legislation, a consumer is a natural person acting for purposes outside their trade, business, craft or professional activity.

Specific consumer rights provided by legislation governing distance contracts, including the statutory right of withdrawal, apply to persons who qualify as consumers under the law.

For orders placed by legal entities, professionals, sole traders, individual enterprises or other entities purchasing products in connection with their professional or commercial activity, commercial, return and warranty conditions may differ and are governed by the applicable contract, offer, invoice, product documentation and legislation governing business-to-business relations.

4. Products and information displayed on the website

Marketing Olfactiv sells products intended for ambient scenting, as well as other products presented in the online store, including scent diffusers, ambient fragrances, accessories and related products.

We make reasonable efforts to ensure that product descriptions, images, technical specifications, prices and availability information are accurate and up to date.

Product images are provided for presentation purposes. Depending on the device used, screen settings, lighting conditions, production batch or changes introduced by the manufacturer, minor differences in colour, finish, packaging or appearance may occur without affecting the essential functionality of the product.

In the case of ambient fragrances, olfactory perception is subjective and may vary from one person to another, as well as depending on the surface area, volume, ventilation, temperature and configuration of the space in which the product is used.

5. Prices

The applicable prices are those displayed on MarketingOlfactiv.ro at the time the order is placed, except in the event of obvious display or processing errors.

Information regarding VAT, delivery charges and any other applicable costs is displayed in the store and/or during checkout before the order is submitted.

Marketing Olfactiv may change product prices for future orders. A subsequent price change does not affect orders that have already been accepted, except where there has been an obvious technical error and the buyer is informed before the order is fulfilled.

6. Placing an order

Products can be ordered online through MarketingOlfactiv.ro and, where available, by phone or email.

By placing an order, the buyer submits a request to purchase the selected products from Marketing Olfactiv.

After submitting the order, the buyer may receive an automated message confirming that the order has been registered. This message confirms that the order has been received by the system.

Where clarification is required regarding product availability, configuration, delivery address, payment or other elements of the order, Marketing Olfactiv may contact the buyer before processing or dispatching the products.

7. Product availability

Availability displayed on the website is updated according to the information recorded in the store system.

In exceptional circumstances, temporary stock discrepancies may occur as a result of simultaneous orders, inventory errors, supplier updates or technical issues.

If an ordered product is no longer available, the buyer will be informed. If payment has already been made and the order cannot be fulfilled, the amount paid for the unavailable product will be refunded in accordance with the applicable method and timeframe.

8. Payment methods

Available payment methods may include:

• online card payment;
• cash on delivery;
• bank transfer.

9. Delivery

Products are delivered using the delivery methods available and displayed during the ordering process.

Delivery charges are communicated before the order is confirmed. Any free-delivery conditions or shipping promotions are those displayed on the website at the time the order is placed.

The buyer is responsible for providing accurate and complete delivery information.

Delivery times communicated are estimates unless a firm delivery deadline is expressly stated. Delays may occur due to circumstances beyond the reasonable control of Marketing Olfactiv, including courier delays or force majeure events.

10. Right of withdrawal for consumers

Consumers benefit from the statutory right of withdrawal from distance contracts in accordance with Government Emergency Ordinance no. 34/2014.

As a general rule, the consumer has the right to withdraw from the contract within 14 days, without having to provide a reason, subject to the conditions and exceptions provided by law.

The applicable period, procedure for exercising the right of withdrawal, return costs, product-condition requirements and legal exceptions are described in our Return Policy.

The statutory right of withdrawal applicable to consumers does not automatically extend to purchases made by legal entities or professionals for purposes related to their economic activity.

11. Checking products upon delivery

We recommend checking the parcel and the products as soon as reasonably possible after delivery.

If you notice damage caused during transport, missing products, products different from those ordered or any other issue, please contact us as soon as possible at info@marketingolfactiv.ro or +40 767 572 300 so that we can investigate the situation and identify the appropriate solution.

This recommendation does not limit the consumer’s statutory rights.

12. Product conformity and warranty

For consumers, goods sold by Marketing Olfactiv benefit from the statutory guarantee of conformity under the applicable legislation, including Government Emergency Ordinance no. 140/2021.

The seller is liable for non-conformities of the goods under the conditions and for the period provided by law. Certain products may also benefit from an additional commercial warranty offered by the manufacturer or by Marketing Olfactiv, subject to the terms stated in the product documentation.

To the extent permitted by law, the warranty does not cover damage caused by improper use, failure to follow operating instructions, unauthorised interventions, accidents, normal wear and tear or the use of incompatible consumables where these are the cause of the defect.

13. Proper use of products

The buyer must use products in accordance with their intended purpose, the instructions provided, technical specifications and the recommendations of the manufacturer or seller.

For scent diffusers, performance and fragrance consumption may vary depending on device settings, the size and configuration of the space, ventilation, temperature, placement and operating schedule.

We do not recommend using fragrances, consumables, power supplies, components or accessories that are incompatible with the product where such use may affect the performance or safety of the equipment.

14. User account

Creating an account is not mandatory in order to place an order where the platform allows checkout without an account.

If an account is created, the user is responsible for providing accurate information and for maintaining the confidentiality of their login credentials.

If unauthorised use of the account is suspected, we recommend changing the password and contacting Marketing Olfactiv.

15. Intellectual property

The content available on MarketingOlfactiv.ro, including text, photographs, graphic elements, video materials, trade names, design elements, databases and other materials, is protected by copyright, trademark and intellectual property laws.

The content may belong to MARKETING OLFACTIV S.R.L., its partners, manufacturers or other rights holders who have authorised its use.

Copying, reproducing, distributing, modifying or commercially using the content without the consent of the rights holder is prohibited, except where expressly permitted by law.

16. Reviews and user-submitted content

Users may be able to publish reviews or submit opinions regarding purchased products.

Submitted content must not be unlawful, offensive, discriminatory, fraudulent, infringe the rights of others or contain personal data relating to third parties without permission.

Marketing Olfactiv reserves the right to moderate or remove content that breaches these rules or applicable law, without artificially altering the meaning of legitimate reviews.

17. Limitation of liability

Marketing Olfactiv makes reasonable efforts to ensure the continuous and correct operation of the online store but cannot guarantee that the website will operate permanently without interruptions, errors or technical unavailability.

Marketing Olfactiv is not responsible for damage caused exclusively by improper use of products, failure to follow instructions, incorrect information provided by the buyer or circumstances outside the reasonable control of the company.

Nothing in these Terms and Conditions limits or excludes any rights granted to consumers by applicable law.

18. Force majeure

Neither party shall be liable for failure to perform contractual obligations where such failure is caused by a force majeure event or fortuitous event, in accordance with applicable law.

19. Personal data protection

Personal data provided through the online store is processed in accordance with applicable data-protection legislation.

20. Complaints and dispute resolution

For any issue relating to an order or product, we recommend contacting Marketing Olfactiv directly so that an appropriate solution can be identified.

Consumers may use alternative dispute resolution mechanisms and may contact the competent consumer-protection authorities, in accordance with applicable law.

Any disputes that cannot be resolved amicably will be settled by the competent courts in accordance with applicable law.

21. Changes to these Terms and Conditions

Marketing Olfactiv may periodically update these Terms and Conditions in order to reflect legislative, commercial, technical or operational changes.

Changes apply from the date the updated version is published on the website and do not retroactively affect rights and obligations arising from orders already concluded, except where required by law or agreed between the parties.
